9  Insurance Proceeds

Notwithstanding the other provisions of this Agreement and the terms and conditions of the Senior Financing Agreements, the Facility Agent shall only permit amounts to be released from the Joint Insurance Account in accordance with the requirements of clause 58 (Reinstatement and Change of Requirement after Insured Event) of the Project Agreement and the Facility Agent agrees for itself and on behalf of the Secured Finance Parties that it shall not exercise any rights under the Senior Financing Agreements or take any other steps to prevent amounts being released from the Joint Insurance Account in accordance with clause 58 (Reinstatement and Change of Requirement after Insured Event) of the Project Agreement.
