86.1  Common Law Rights for the Contractor

Without prejudice to any entitlement of the Contractor:

86.1.1  to specific performance of any obligation under this Agreement; or

86.1.2  to injunctive relief; or

86.1.3  to any other express right of the Contractor pursuant to this Agreement;

the Contractor's sole remedy in relation to any Compensation Event in respect of any Site that occurs prior to the completion of the Works at that Site shall be the operation of clause 16.5 (Effect of a Compensation Event).
