7.  Disclaimer

Bidders should note the contents of Section [insert details] of the ISDS Instructions and Guidance to Bidders (which continues to apply as if set out herein mutatis mutandis) and should additionally note the following points:

•  No statement or thing contained in the ISRS Document or made or undertaken as part of the ISRS process is intended to or shall be taken as constituting a Contract, agreement, warranty or representation between the Local Authority and any other party (excluding a formal award of Contract made by the Local Authority or any formal express legal agreement).

•  For the avoidance of doubt the revised Model Contract set out in Appendix 9 is subject to Contract and entirely without prejudice to the Local Authority's legal position.

•  The Local Authority has not made and will not make any Contract, agreement, warranty or representation that a Contract will be offered in accordance with this ISRS Document (including any timetable for the award of Contract).

•  The Local Authority does not accept any responsibility for any pre-contractual representations made by it or on its behalf or for any estimates made by Bidders of resources to be employed in meeting the Local Authority's requirements or for any other assumption that Bidders may draw from any pre-contractual negotiations.

•  The Local Authority accepts no liability to pay for any quotation or other preparatory work undertaken in connection with this ISRS document or any other communication between the Local Authority and any other party.

•  The Local Authority is not committed to any course of action as a result of issuing this ISRS document or discussing with any party in respect of it or any other communication between the Local Authority and any other party.
