Part I - Service Availability Requirements

Services Availability Requirements shall mean, where applicable:

i)  the Works have been provided in accordance with the Facilities Requirements and the Construction Proposals, and any relevant planning approvals;

ii)  the Works have been designed, constructed, remodelled or refurbished in the forms and materials described and as approved in any planning approvals and the Facilities Requirements and Construction Proposals;

iii)  the [Facility is/Facilities are] Available1;

iv)  the Buildings have been located on [the/each] Site, together with landscaped areas, and with the sports and recreational facilities as shown in the Authority's Requirements and the Construction Proposals and as approved in any planning approvals;

v)  external fencing, gates, security equipment, vehicular and pedestrian access are complete as described in the Facilities Requirements and the Construction Proposals;

vi)  the Buildings are weatherproof and watertight;

vii)  the building services, the drains, the fire and intruder alarm installations and any other security related equipment comply with the Facilities Requirements and the Construction Proposals in all material respects;

viii)  the Buildings, and where relevant the Site[s], are clean and tidy and all debris, surplus material and rubbish has been removed;

ix)  the Contractor has provided Part 1 of the Building Manual;

x)  the mechanical and electrical plant and equipment have been tested on Site[s] to ascertain compliance with the Facilities Requirements and the Construction Proposals and meet the standards set out in the Facilities Requirements and the Construction Proposals;

xi)  all mechanical and electrical installation work is complete and the plant and equipment are safe for use;

xii)  the Collateral Warranties have been duly executed and delivered to the Authority.2

1 This wording has been preferred to the Building Schools for the Future wording.  In a leisure project the Availability Criteria ensure the Services are capable of being delivered (e.g. the equipment is present and there are appropriate staffing levels).  This is obviously of key importance to the Authority.
