2.5  Non Service of Notice

Where the Authority does not serve a notice pursuant to clause 2.4:

(a)  the Service Commencement Date shall be the Planned Service Commencement Date; and

(b)  and does not otherwise make known to the Service Provider its opinion that clauses 2.3(a) to 2.3(c) (inclusive) have not been complied with, this shall not be taken as acceptance by the Authority that the Service Provider has complied with its mobilisation obligations in clauses 2.3(a) to 2.3(c) (inclusive),

and for the avoidance of doubt, whether or not the Authority serves a notice under clause 2.4, the Service Provider shall not be relieved of its obligations pursuant to clause 2.3.
