2.6  Notice to the Authority

If the Service Provider (acting reasonably) believes that it will not fulfil its obligations under clauses 2.3(a) to 2.3(c) (inclusive) on or before the Planned Service Commencement Date (and clauses 2.4 and 2.5 do not apply), it shall serve notice to that effect on the Authority no later than ten (10) Business Days before the Planned Service Commencement Date in which event:

(a)  the Service Provider shall give the Authority not less than five (5) Business Days notice in writing of the date the Service Provider intends to notify the Authority that the requirements of clauses 2.3(a) to 2.3(c) (inclusive) have been satisfied (the Intended Service Commencement Date);

(b)  following receipt of such notice, the Authority shall, by notice in writing to the Service Provider before the Intended Service Commencement Date, require the Service Provider to demonstrate to the Authority's reasonable satisfaction that the Service Provider has complied with the requirements of clauses 2.3(a) to 2.3(c) (inclusive).  If the Authority is not reasonably satisfied that the requirements of clauses 2.3(a) to 2.3(c) (inclusive) have been complied with, the Authority may prevent the Service Provider from commencing the Service on the Intended Service Commencement Date by notice in writing to the Service Provider, and such notice shall include the Authority's reasons for its decision;

(c)  the procedure in clauses 2.6(a) and 2.6(b) shall continue until the Authority is reasonably satisfied that the requirements of clauses 2.3(a) to 2.3(c) (inclusive) have been complied with in which case the Service Provider shall notify the Authority in writing that the said requirements have been complied with.
