12.9  Completion of a Milestone7

Completion of a Milestone shall occur when the cumulative number of CIP Apparatus Certified as having been Removed by the Independent Certifier at that time is greater than that required for the relevant Milestone as set out in Table 1 and for the avoidance of doubt:

(a)  each Milestone shall be calculated by reference to the percentage of CIP Apparatus which have been Certified as being Removed (rather than by reference to the number of Replacement CIP Apparatus which have been Certified as having been Installed) pursuant to the Core Investment Programme Service; and

(b)  no item of CIP Apparatus shall be Certified as having been Removed unless it has been replaced with a item of Replacement CIP Apparatus which meets the requirements of this Contract, including without limitation the Output Specification (subject to any Snagging Items) and has been Certified as Installed.
