18.4  Excusing Cause

From the date twenty (20) Business Days after the date the Authority first meets with the Service Provider pursuant to clause (b) until the earlier of:

(a)  the Service Provider or the Authority obtains the Necessary Consent to affix the Apparatus;

(b)  the Apparatus is installed in another location in accordance with paragraphs 5.5(h) or 5.9(f) of the Output Specification;

(c)  a Design Variation Approval is issued pursuant to paragraph 8 of Schedule 7 (Review Procedure);

(d)  the relevant Apparatus is De-Accrued in accordance with Schedule 15 (Accrual and De-Accrual of Apparatus);

(e)  an Authority Change is implemented in accordance with the Change Protocol,

any failure to obtain a Necessary Consent to affix Apparatus to a structure other than other Apparatus shall constitute an Excusing Cause for the purposes of the Payment Mechanism.
