25.6  Change in Standards

Notwithstanding any other provision of this Contract, any increased costs incurred as a result of:

(a)  changes in burning hours which result from a change from EAC to PECU as the measurement of usage; and

(b)  changes in any [Streetlighting Standard] [Codes of Practice]18 to the extent that such changes do not have a retrospective effect,

shall be paid for by the Service Provider and shall not be a Qualifying Change in Law.

18  Authority should note that the Codes of Practice include all relevant Standards and Codes and may therefore be seen as too onerous on the Service Provider to represent value for money.  The Authority may wish to refer to a shorter list which could be defined as Streetlighting Standards.  A proposed definition is included.
