38.2 Books of Accounts
Compliance with clause 38.1 shall require the Service Provider to keep (and where appropriate to procure that each Sub-Contractor shall keep) books of account in accordance with best accountancy practice with respect to this Contract showing in detail:
(a) administrative overheads;
(b) payments made to a Sub-Contractors and by a Sub-Contractor;
(c) capital and revenue expenditure; and
(d) such other items as the Authority may reasonably require to conduct cost audits for verification of cost expenditure or estimated expenditure, for the purpose of this Contract including clause 21 (Compensation Events etc.), clause 25 (Change in Law), clause 27 (Revenue Sharing and Additional Income), Schedule 9 (Electricity Procurement), Schedule 10 (Original Non-Contestable Works) and the Change Protocol,
and the Service Provider shall have (and procure that a Sub-Contractors shall have) the books of account evidencing the items listed in clauses 38.2(a) to 38.2(d) (inclusive) available for inspection by the Authority (and any experts) upon reasonable notice, and shall present a report of these to the Authority as and when requested.
