40.3  Exclusive Right to Terminate

Each and any of the events referred to in:

(a)  clause 41.2 (Service Provider Default) constitutes the only breaches of this Contract or any Project Document which shall permit termination of this Contract by the Authority; and

(b)  clause 43.1 (Termination on Authority Default) constitutes the only breaches of this Contract or any Project Document which shall permit termination of this Contract by the Service Provider.
