62.2  Sole Remedy

Subject to:

(a)  any other express right of the Authority pursuant to this Contract; and

(b)  the Authority's right to claim, on or after termination of this Contact, the amount of its reasonable costs, losses damages and expenses suffered or incurred by it as a result of rectifying or mitigating the effects of any breach of this Contract by the Service Provider, save to the extent that the same has already been recovered by the Authority pursuant to this Contract or has been taken into account to calculate any compensation payable by the Authority pursuant to clause 31.4(b) (Uninsurable Risks), clause 41 (Termination by the Authority), clause 42 (Termination for Corrupt Gifts and Fraud), clause 43 (Termination by the Service Provider) and clause 44 (Termination following a Force Majeure Event),

the sole remedy of the Authority in respect of a failure to provide the Service in accordance with this Contract shall be the operation of the Payment Mechanism.
