Emoluments and Outgoings (Clause 1.3)

2.26  Since under TUPE all rights, liabilities etc of the transferor (i.e. the Authority or an existing contractor of the Authority) in relation to the employees who transfer to the transferee, transfer to the Contractor, a contractual apportionment of such liabilities is required. Clauses 1.3.1 and 1.3.2 achieve this by making the transferor responsible for all liabilities pre-transfer and the Contractor responsible post-transfer.
