Undertaking from the Contractor (Clause 2.8)
3.24 The Contractor is required to provide all reasonable information that the Authority or the Administering Authority and its advisors need for the administration of the LGPS, the Contractor Scheme or the bulk transfer terms. It must also ensure it does not do anything which would impose on the Contractor Scheme or the Authority a greater cost in respect of any eligible employee than would normally be payable and nor will it make any announcement concerning ABS or cessation of ABS without obtaining the written consent of the Authority and the Administering Authority.
3.25 Clause 2.8.1(d) requires the Contractor and its Sub-Contractors not to take or omit to take any action which would materially affect the benefits under the Contractor Scheme or the LGPS in respect of any eligible employee without the prior written consent of the Authority. The Contractor is however allowed to do so to the extent such action was permitted under a former contract of employment.
3.26 Since LGPS is only for local government employees, the Contractor must ensure, if an employee ceases to be eligible for membership by virtue of not providing the services to the Authority, s/he must be offered membership of the Contractor Scheme.
