Decision to Refuse Admission (Clause 3.6)

4.10  The Authority's decision concerning refusal of access is conclusive. However, if it refuses to give reasons for its decision, the person refused may bring an action against the Contractor or Sub-Contractor and the Authority is required to indemnify the Contractor or Sub-Contractor as appropriate against any injury, claims, costs, expenses or damage incurred as a result. The Contractor/Sub-Contractor have a duty to mitigate and ensure they make a reasonable attempt to re-deploy the person elsewhere.
