Relief from Deductions (Clause 3.8)
4.12 If the Contractor/Sub-Contractor have complied with their respective obligations under these additional employee provisions but the Authority has acted unreasonably in performing its obligations, the Authority is required to compensate the Contractor by giving a reasonable period of relief from Service performance deductions in respect of the Service affected by the person refused access. Such a provision ensures the Authority will use the powers it has under these provisions following due and proper consideration and not frivolously.
4.13 Resources and Training (Clause 3.10)
The Authority will require that the Contractor engages sufficient persons in the provision of the Services, and with the appropriate level of skill and experience throughout the term of the Agreement, including holidays and peaks in Service demand. It will also require assurance that such persons are adequately supervised and trained to perform the Services in accordance with the specification and the terms of the Agreement.
