1  Definitions

1.1  Any terms and expressions used in this Part A of the Services Specification shall bear the same meaning as set out in clause 1 (Definitions and Interpretation) of this Agreement unless set out below or the context otherwise requires

Ad Hoc Service Request means a request from a User or the Authority for a Service which the Authority is entitled to require the Contractor to provide but the obligation to provide such service does not arise unless or until it is requested20

Capital Equipment means equipment that is built into the Facility, specifically for the delivery of the Services, including any items that are permanently plumbed in or wired in to Facility

Emergency Fault means a fault or failure in the Facility to be Contained in the Containment Time and Rectified in the Rectification Time by the Contractor in the periods set out in Appendix 4 to this Part A of the Services Specification

Equipment means all equipment [including the Capital Equipment] [but excluding the Sports Equipment] required to provide the Services

Fire Certificate means Fire Certificate required pursuant to the provisions of the Fire Regulatory Orders 2006

Fire Safety Policy means the Authority's Policy of that name

Infrastructure Services means the services required to meet the Maintenance Services Standards set out under the heading "Building" in Appendix 2 to this Part A of the Services Specification

Maintenance means any maintenance, upkeep, repair, replacement or renewal of any part of the Facility in accordance with the Maintenance Services Standards and the requirements of manufacturers original and subsequently amended specifications and warranties, including Equipment and Maintain shall be construed accordingly

Maintenance Services means the Services to be carried out pursuant to this Part A of the Services Specification

Maintenance Services Standards means the Service standards set out at Appendix 2 to this Part A of the Services Specification

Mechanical and Electrical Services means the services (including related Equipment) listed in Appendix 3 to this Part A of the Services Specification

Nominated Officer (Fire) means the person so nominated by the Authority responsible for matters of fire safety

PAT means Portable Appliance Testing

Pest has the meaning given to it in Part E of this Services Specification

Routine Fault means a fault or failure in the Facility to be Contained in the Containment Time and Rectified in the Rectification Time by the Contractor in the periods set out in Appendix 4 to this Part A of the Services Specification

Service Standards means the standards of performance of the Maintenance Services by the Contractor which shall be:

(a)  so far as not in conflict with an express obligation of the Contractor under this Agreement or where in relation to a matter there is no express obligation or standard imposed on the Contractor under this Agreement, in accordance with Good industry Practice;

(b)  in a manner consistent with the Quality Plans;

(c)  in a manner not likely to be injurious to health or to cause damage to property;

(d)  in a manner consistent with the Authority discharging its statutory duties and other functions undertaken by it as the same may be notified to the Contractor from time to time;

(e)  in compliance with all Legislation and Necessary Consents (including without limitation the giving of notices and the obtaining of any such Necessary Consents) and so as not to prejudice the renewal of any such Necessary Consents; and

(f)  except to the extent expressly stated to the contrary in the Facilities Requirements or the other Parts of this Services Specification in compliance with all applicable Facilities Requirements

Sports Activities has the meaning given to it in Part B of this Services Specification

Sports Equipment has the meaning given to it in the Payment Mechanism

Staff shall have the meaning given to it in Part D of this Services Specification

Suitably Qualified Person has the meaning ascribed to "Suitably Qualified Person" in the HTM Guidance Notes

Urgent Fault means a fault or failure in the Facility to be contained in the Containment Time and Rectified in the Rectification Time by the Contractor in the periods set out in Appendix 4 to this Part A of the Services Specification
