1  Definitions

Any terms and expressions used in this Part B of the Services Specification shall bear the same meaning as set out in clause 1 (Definitions and Interpretation) of this Agreement unless set out below or the context otherwise requires.

Authority Pricing Requirements means the section of the Authority Leisure Requirements which sets out the Authority's pricing policy, including the Core Prices and any other pricing related matters as updated from time to time in accordance with this Part B of the Services Specification

Authority Protected Organisations means those organisations listed in the Authority Leisure Requirements

Authority Leisure Requirements means the document set out in Appendix 2 as updated by the Authority in accordance with this Part B of the Services Specification and which shall contain:

(a)  the Target Community and/or the Authority Protected Organisations;

(b)  the Authority Pricing Requirements;

(c)  the Programme of Use;

(d)  the Terms and Conditions of Hire;

(e)  the Participation Targets; and

(f)  any other requirements of the Authority.

Core Prices means the maximum prices that the Contractor may charge for the Priority Bookings to Authority Protected Organisations as set out in the Authority's Pricing Requirements

Designated Times means the times during which Priority Bookings shall take place as set out in the Authority Leisure Requirements

Estimated Changed Costs has the meaning given to it in paragraph 4.5 of this Part B of the Services Specification

Fees and Charges Policy means the schedule of charges the Contractor proposes to make for the Sports Activities and other uses to be made of the Facility

Marketing and Communications Plan means the plan forming part of the SPADP produced and updated by the Contractor in accordance with this Part B of the Services Specification which shall contain, as a minimum, the information set out in paragraph 8 of this Part B of the Services Specification

Minimum Opening Hours means the periods set out in paragraph 11.2 of this Part B of the Services Specification or (in the case of Zone) in the Zone Data Sheets and during which the Facility or the Zone (as appropriate) must be open and available to Users

Opening Hours means the periods that the Facility, or as the case may be, a Zone is open, which, for the avoidance of doubt, shall not be less than the Minimum Opening Hours

Participation Targets means the targets specified by the Authority and established to increase usage of the Facility by the Target Community as set out in the Authority Leisure Requirements

Performance Monitoring Report has the meaning given to it in the Payment Mechanism

Priority Bookings means those Sports Activities specified by the Authority in the Authority Leisure Requirements

Programme of Use means the programme setting out all Priority Bookings and Designated Times

Reception Helpdesk has the meaning given to it in Part C of the Services Specification

Sports Activities means all sports and activities that take place at the Facility including [list can be included]

Sports and Physical Activity Development Plan and SPADP means the document set out in Appendix 3 as updated by the Contractor in accordance with paragraph 3 of this Part B of the Services Specification and which shall contain, as a minimum:

(g)  the Contractor's proposals for satisfying the Authority Leisure Requirements;

(h)  the Contractor's proposals for achieving the outcomes specified in paragraph 2.1 of this Part B of the Services Specification;

(i)  a Programme of Use;

(j)  the Fees and Charges Policy;

(k)  the Contractor's proposals (if any) to promote, operate, sell and administer a Leisure Card Scheme throughout the Services Period;

(l)  any changes required by the Contractor, such as a change in Opening Hours;

(m)  the Marketing and Communications Plan28;

(n)  any other proposals for enhancing use of the Facility; and

(o)  the information set out in paragraph 3.3 of this Part B of the Services Specification

Staff shall have the meaning given to it in Part D of this Services Specification

Target Community means:

(p)  people on low incomes (which shall mean people receiving any of the following:

•  Job Seekers Allowance;

•  Income Support;

•  Housing/Council Tax Benefit;

•  Working Tax Credit;

•  Pension Credit (Guaranteed Element) aged 60-65 years;

(q)  people with disabilities;

(r)  children and young people (which shall mean people aged 19 and under);

(s)  black and other minority ethnic groups;

(t)  refugee and asylum seekers; and

(u)  older people (which shall mean people over 65)

Terms and Conditions of Hire means those terms and conditions pursuant to which the Authority Protected Organisations may use the Facility for Priority Bookings

User Satisfaction Surveys has the meaning given to it in Part C of this Services Specification
