9  Advertising and Publicity

9.1  All proposals for advertising or product placement at the Facility or any sponsorship or activity or event at the Facility shall require the prior written consent of the Authority's Representative.

9.2  The Authority may make use of any space within the Facility, free of charge, for promotional and publicity material and the Contractor shall make such space available to the Authority within [] Business Days of any written request from the Authority setting out details of the space required.

9.3  The Contractor shall comply with the provisions of clause 78 (Public Relations and Publicity) of this Agreement and in particular shall ensure that all contact with the media shall be referred through the Authority's public relations department.

9.4  The Authority shall be recognised in all marketing material and signage produced by the Contractor concerning the Facility or any of the Services and the wording shall be subject to prior written approval by the Authority.

9.5  The design to be used in the production of marketing materials and signage shall be set out in the Marketing and Communications Plan and, for the avoidance of doubt, shall require the approval of the Authority prior to use.

9.6  The Contractor shall ensure that the Authority's name and logo appears on all external signage, signage in reception areas and all promotional mediums including web sites and published material (including stationery) relating to the Facility.  

9.7  The Contractor will use the wording "[insert name] working in partnership with [insert name] Council" in all materials and publications relating to the Facility provided that where the Contractor enters into any sponsorship agreements, the sponsor's name may also appear, with the approval of the Authority.

9.8  There shall be uniformity of branding, for example, colour schemes, designs and styling across the Facility.  

9.9  The Contractor shall ensure that no advertising/publicity material likely to cause offence to or mislead the public or cause embarrassment to the Authority is used.  Where the Authority (acting reasonably) is of the view that any advertising or promotional material is likely to breach this condition, it shall inform the Contractor who shall immediately take steps to remove such material.  The Authority shall not be liable for any loss incurred as a consequence of the removal of any such material.

9.10  All advertising material and publications shall comply with the standards specified by the Advertising Standards Authority and Trading Standards Board.  

9.11  The Contractor may sell a limited amount of advertising space inside the Facility (e.g. poster advertising, advertising boards on the outdoor pitches) subject to the prior written consent of the Authority which, for the avoidance of doubt, may be given as part of the approval of the Marketing and Communications Plan.  Only high quality framed poster advertising will be allowed internally and shall be displayed only in the approved sites.  The Contractor shall ensure that all contracts entered into for the display of advertising shall terminate automatically upon the Expiry Date or, if earlier, the Termination Date or (if required by the Authority) be capable of assignment to the Authority on such date.

9.12  The Contractor shall ensure that at all times when the Facility is open to Users printed information setting out the opening hours of the Facility, the services and activities available and the prices charged is easily available.  The Contractor shall ensure that such information is on display and when set out in any publication or advertisement, it is up to date, accurate and attractively presented.

9.13  The Contractor shall ensure that, as a minimum, promotional material is distributed to all the local Tourist Information Centres, the Leisure and Marketing Departments of [other local authorities], other sports centres throughout the [District/Borough], all public libraries and (where appropriate) to local clubs and organisations.  The Contractor shall assist and co-operate with the Authority in the distribution of sponsored promotional publications, for example, tourist/conference brochures.

9.14  Sports development notice boards and other means of publicity shall be provided throughout the Facility to ensure that sports development information is easily available.  The Contractor's website shall provide information on sport development at the Facility.
