Service Requirements
4.1 The Contractor shall, at all times, operate and effective management structure with clear responsibilities and lines of communication.
4.2 The Contractor shall appoint a Contract Manager to manage the Facility and the Services. For the avoidance of doubt, the Contract Manager may (but does not have to be) appointed as the Contractor's Representative. The Contract Manager shall:
(a) be in overall control and responsible for the operation of the Facility and provision of the Services; and
(b) attend such meetings with the Authority as the Authority may request from time to time.
4.3 During all Opening Hours a Duty Manager (who shall be a suitably qualified and experienced person) shall be present at the Facility. The Duty Manager shall be readily identifiable and be responsible for the management and operation of the Facility during his/her designated duty period. The Duty Manager shall be empowered to make such decisions as may be necessary to ensure the safety of the Users and protect the condition of the Facility.
4.4 The Contractor shall, prior to the Planned Services Availability Date, notify the Authority of the management structure, individuals, responsibilities and lines of communication put in place by the Contractor in respect of each of the Services and shall notify any changes to the Authority.
