11. Fraudulent or Erroneous Reporting
If there are any errors in the monthly monitoring report then the two parties need to agree the amendment to the report or if they disagree the matter can be referred to Dispute Resolution Procedure (DRP).
If the error is because the Service Provider has failed to accurately report or monitor an Event then this is classed as a new Performance Failure and will be the equivalent of five Performance Failures with no containment or rectification times.
The Service Provider has to provide a copy of all its records on an open book basis and pay the Authority its reasonable costs in carrying out any investigation.
If further discrepancies are found by the Authority during its investigation then further Deductions can be made.
