17.  Unavailability Ratchet

If Unavailability occurs in the same Zone six times or more in a three month period then for subsequent occurrences there is no containment or rectification period.

The seventh and subsequent deductions are multiplied by a Ratchet ('R') of [two].

The Payment Mechanism sets out a series of Unavailability and Performance Ratchets whereby the level of Deductions is ratcheted up in certain instances, for example, where a Zone does not meet the Availability Criteria for more than 8 Contract Days (not necessarily consecutive days) within a Contract Month, the Unavailability Deduction in respect of that Zone will be doubled and this level of Deductions will continue to apply until the Zone is Unavailable for 8 or less Contract Days in a Contract Month. Ratchet clauses are outlined in Part 3 para 4, Part 4 para and Part 5 para 3 of the Model Payment Mechanism (Model 8).
