3  Containment and Rectification

3.1  Where an Event leads to a failure to meet an Availability Requirement or a Performance Standard which is allocated a Containment Time and/ or Rectification Time in a Zone Data Sheet, the Containment Time and/ or Rectification Time for the Event shall be that set out in the Zone Data Sheets.  The Contractor shall Contain or Rectify an Event within its relevant Containment Time and/or Rectification Time.  The Rectification Time and the Containment Time (if any) applicable to the Event shall commence from the Notification Time.

3.2  Where an Event has been give a Priority Level pursuant to paragraph 2.1 the Containment Time and Rectification Time for the Event shall be as set out in Table A (in paragraph 2.1) unless a Containment Time or Rectification Time (as the case may be) is set out in the relevant Zone Data Sheet.

3.3  The Contractor shall give notice ("Rectification Notice") to the Help Desk:

(a)  the time the Event has been contained (if applicable); and

(b)  the time the Event has been Rectified,

and the Containment Time and/or Rectification Time shall be logged.

3.4  If an Event occurs due to failure by a Utility supplier to supply Utility Services to the Facility (through no fault of the Contractor or any Contractor Related Party), the Rectification Time in respect of each Availability Requirement and Performance Standard failed due to such Event for each effected Zone shall be increased to seven (7) Contract Days.  For the avoidance of doubt, the Rectification Times specified in Table A at paragraph 2.1 of this Part 2 or the Zone Data Sheets (as appropriate) shall not apply but the Containment Times (if any) shall apply in such circumstances.

3.5  Should the failure by a Utility supplier to supply Utility Services to the Facility (through no fault of the Contractor or any Contractor Related Party) continue for a period in excess of seven (7) days then the Contractor is entitled to apply for Rescheduled Rectification.
