4  Event Categories

4.1  An Event shall be a Failure Event unless:

(a)  it has been caused by an Excusing Cause;

(b)  it is Contained within the relevant Containment Time (if any) and/or Rectified within the relevant Rectification Time (or any Rescheduled Rectification Time if appropriate); or

(c)  the provisions of paragraph 5.2 of this Part 2 apply.

4.2  At the end of each Contract Day each Event report to the Helpdesk shall be awarded an Event Category by the Contractor on the following basis:

The Event Category Deduction Percentage attributable to the Event Category shall be used to determine the Deductions to be made pursuant to this Schedule. Where an Event falls into Event Category B then Deductions shall only be made for the Operational Period [(if any)] in which that Event occurred.

4.3  For the purposes of calculating Deductions, the period of Unavailability or Performance Failure (as appropriate) shall run from the Notification Time (or if later the commencement of the first Operational Period after the Notification Time) until the time a valid Rectification Notice is timed and dated by the Help Desk. Where there is no Rectification Time, the Event shall be logged as a Failure Event at the Notification Time, save to the extent an Excusing Cause subsists.
