5  Replacement Zones

5.1  Where an Original Zone is Unavailable, the Contractor shall be entitled (but not obliged) to utilise the corresponding Replacement Zone, for the Designated Function of the Original Zone.

5.2  Subject to paragraph 5.5, provided that the Availability Requirements applicable to the Original Zone are satisfied in the Replacement Zone, no Unavailability Deductions shall accrue in respect of the Original Zone.  

5.3  Where a Replacement Zone is utilised pursuant to paragraphs 5.1 and 5.2, then such Replacement Zone shall be deemed to be Unavailable provided that for its Designated Function purpose. For the avoidance of doubt, Deductions shall accrue in respect of the Replacement Zone, until the Replacement Zone is restored to its Designated Function in the relevant Zone Data Sheet and meets the Availability Requirements specified for that Original Zone.  

5.4  Where a Replacement Zone is utilized but:

(a)  was not pre-booked and can no longer be used for the pre-booked Sport Activity; or

(b)  was not required for a Sport Activity pursuant to the Authority Pricing Requirements and such Sport Activity can no longer take place,

the Deduction shall be reduced by 50%.

5.5  Notwithstanding paragraphs 5.1 – 5.4:

(a)  if any Original Zone is not available within six (6) Operational Periods of the Notification Time of the Availability Failure, then Availability Deductions shall be made in respect of both the Original Zone and the Replacement Zone from the first Operational Period after the expiry of the six (6) Operational Periods and shall continue for each Operational Period thereafter until the Original Zone is Available; and

(b)  the Contractor shall only be entitled to utilise a Replacement Zone in respect of the same Original Zone on one occasion each Contract Month.

5.6  For the avoidance of doubt, the Contractor shall be entitled to withdraw the Replacement Zone at any time, and in such circumstances (subject to the Replacement Zone meeting the Availability Requirements) Unavailability Deductions shall only accrue in respect of the Original Zone.
