1  Subject to paragraph 2 of this Part 3, where there is an Availability Failure, an Unavailability Deduction shall be made from the MUC for each affected Zone for each Operational Period (or part thereof): -

(a)  from the Operational Period in which the Availability Failure first occurs or where the Availability Failure first occurs outside of an Operational Period, from the first Operational Period in which the Availability Failure subsists;

(b)  until the Availability Failure is Rectified.

2  Where an Event which, if not Rectified, would be an Availability Failure, falls into Event Category B, then an Unavailability Deduction will be made in respect of the Operational Period in which the Event occurs notwithstanding that Rectification is carried out in the Rectification Time.

3  Subject to any ratchet applicable pursuant to paragraph 4 of this Part 3, the Unavailability Deduction for each Operational Period (or part there of) for each affected Zone shall be calculated in accordance with the following formula:

Where:

UD is the Unavailability Deduction calculated for the Availability Failure;

UCn is the Unitary Charge for the relevant Contract Year calculated in accordance with paragraph 3 of Part 1;

ZW is the Zone Weighting relating to the affected Zone as set out in Appendix 1 to this Schedule;

EC is the Event Category Deduction Percentage derived from Table B at paragraph 3.2 of Part 2 of this Schedule [and relevant only to Events that have a Rectification Time];

TOP is the total number of Operational Periods for which the relevant Zone is to be opened in the Contract Year ;

R is the Multiplier if the ratchet referred to in paragraph 4 of this Part 3 is applicable. If it is not applicable R is one (1).

The Unavailability Deduction is multiplied by the number of Operational Periods in the affected Zone during which an Availability Failure occurs.
