1  Where there is a Performance Failure of a Zone Performance Standard, a Deduction shall be made from the MUC for the affected Zone for each Operational Period (or part there of);

(a)  from the Operational Period in which the Performance Failure first occurs; or where the Performance Failure first occurs outside of an Operational Period, from the first Operational Period in which the Performance Failure subsists;

(b)  until the Performance Failure is Rectified.  

2  Where an Event which, if not Rectified would be an Availability Failure falls into Event Category B then a Performance Deduction shall be made in respect of the Operational Period in which the Event occurs notwithstanding that Rectification is carried out in the Rectification Time.

3  Subject to any Multiplier applicable pursuant to paragraph 4.3 or 5.1 of this Part 4, the Performance Deduction for each Operational Period (or part thereof) for each:

Where:

PD1 is the Performance Deduction for the Zone Performance Standards;

UCn is the Unitary Charge for the relevant Contract Year calculated in accordance with paragraph 1.1 of part 1;

PW is the Performance Standard Weighting as set out in Appendix 2 to this Schedule;

ZW is the Zone Weighting relating to the Zone (if any) as set out in Appendix 1 to this Schedule where the Performance Failure occurred.  ;

EC is the Event Category Deduction Percentage derived from the table at paragraph 3.2 of Part 2 of this Schedule and relevant only to Events that have a Rectification Time;

TOP is the total number of Operational Periods for which the [relevant Zone] is to be opened in the Contract Year

R is the Multiplier if the ratchet referred to at paragraphs 4 or 5 of this Part 4 is applicable and where there is no ratchet applicable, then R equals one (1).

The Performance Deduction is multiplied by the number of Operational Periods in the affected Zone during which a Performance Failure subsists.
