5  Ratchet for Performance Failures

5.1  Where a Performance Failure of a Zone Performance Standard occurs nine (9) or more times in the same Zone in any three (3) month rolling period in respect of the same Zone Performance Standard then, in respect of the tenth (10th) and subsequent Performance Failures in the same Zone in respect of the same Zone Performance Standard, there shall be deemed to be no Containment Time or Rectification Time and a Performance Deduction shall be made in accordance with paragraph 5.2 for any subsequent Performance Failure of the same Zone Performance Standard occurring in the same three (3) month rolling period.

5.2  Where paragraph 5.1 applies, the Performance Deduction in respect of the tenth (10th) and subsequent Performance Failures shall be multiplied by the Multiplier. Each Performance Failure shall be regarded as a single occurrence for the purposes of this paragraph 5.3 provided such Performance Failure is Rectified within the specified Rectification Time.
