2.3  Installation of Authority Equipment

The procedure for installation of Authority Equipment is as follows:

(a)  the Service Provider shall, no later than the Access Date:

(i)  ensure that the Access Area is in such condition that an Access Certificate can be issued pursuant to paragraph 2.3(d); and

(ii)  grant access to the Authority to the Access Area for the purposes of installing Authority Equipment that is to be installed prior to the Actual Completion Date and associated works;

(b)  the Access Areas are:

(To be completed by the Authority and the Service Provider);

(c)  the Access Dates shall be shown in the Outline Commissioning Programme;

(d)  the Service Provider's Representative shall give to the Authority and the Independent Certifier at least ten (10) Business Days written notice of the date on which the Access Area will have been completed to such a stage that an Access Certificate can be issued.

(e)  the Independent Certifier shall inspect the Access Area and provided that the Access Area is suitable in all regards for installation of the relevant Authority Equipment, the Independent Certifier shall issue a certificate (the Access Certificate);

(f)  where the provisions of paragraph 2.3(e) not have been satisfied, the Service Provider shall give not less than two (2) Business Days notice of dates when a further inspection can take place and this procedure shall continue until the Access Certificate is issued;

(g)  if an Access Certificate has not been issued in respect of an Access Area by the Access Date; the Service Provider shall pay to the Authority any reasonable costs properly and directly incurred as a result of the delay in the issue of an Access Certificate;

(h)  provided that the Service Provider has complied with paragraph 2.3(e) and an Access Certificate has been properly issued by the Access Date the Authority shall not be entitled to contend that completion of the Works has not been achieved if the Authority Equipment or any associated fittings or finishes have not been supplied and/or installed by the Authority in sufficient time to allow the Service Provider to carry out technical commissioning and any other minor finishing and cleaning works (unless due to any act or omission of the Service Provider).  For the avoidance of doubt the Access Certificate has not been issued by the relevant Access Date, Completion of the Works shall not take place until:

(i)  completion of installation and commissioning of the Equipment (excluding, for the avoidance of doubt, the Authority Equipment); and

(ii)  completion of the associated Works.
