1.3  Identity of Adjudicator

The party giving notice of referral of the dispute to the Adjudicator shall put forward the name of the proposed Adjudicator together with details of his/her relevant experience and qualifications.  The other party shall respond within five (5) Business Days indicating whether the proposed Adjudicator can be agreed.  The parties shall use all reasonable endeavours to agree on who should act as the Adjudicator.  In the event of failure to agree the Adjudicator shall be appointed, on the application of either party by:

(a)  the President of the Royal Institution of Chartered Surveyors if the dispute relates to the design or construction of the Social Services Facilities;

(b)  the President of the Law Society in the case of all other disputes.
