1.17  Jurisdiction over Sub-Contractors

The Adjudicator or the Arbitrator, as appropriate, shall not have jurisdiction to determine the Construction Contract Dispute or the Services Contract Dispute but the decision of the Adjudicator or the Arbitrator shall, subject to paragraph 1.11, be binding on the Service Provider and the Construction Contractor insofar as it determines the issues relating to the Construction Contract Dispute and on the Service Provider and the FM Contractor or the Services Contractor (as the case may be) insofar as it determines the issues relating to the Services Contract Dispute.
