8.5  Mitigation - indemnity claims

To avoid doubt the provisions of clause 79 (Mitigation) apply to any indemnity given under this Agreement and any such indemnity shall not apply to the extent that such part or parts of Direct Losses could have been reduced or avoided by the Beneficiary complying with the provisions of such clause 79 (Mitigation).
