25.3  Unprogrammed Maintenance

If, in circumstances other than an emergency, the need arises for maintenance works which are not scheduled to be carried out as part of the Schedule of Programmed Maintenance (Unprogrammed Maintenance), the Service Provider shall only carry out any Unprogrammed Maintenance during the Normal Working Hours unless the Authority Representative has given prior consent to work outside the Normal Working Hours (which consent shall not be unreasonably delayed or withheld) but may be subject to the Service Provider complying with reasonable conditions specified by the Authority Representative.  Nothing in this clause 25.3 (including any approval of the Authority) shall prevent the Authority from making any deductions from the Service Payments pursuant to the Payment Mechanism.
