26.1  Maintenance

The Service Provider shall ensure on a continuing basis that at all times its maintenance and operating procedures set out in the Service Delivery Plans are sufficient to ensure that:

(a)  the Facilities are continuously Available as required by this Agreement and the Authority Construction Requirements;

(b)  the Facilities are kept in good structural and decorative order (subject to fair wear and tear) in accordance with this Agreement, the Authority Construction Requirements, the Service Specifications and the Services Delivery Proposals;

(c)  it can maintain the design intention of the Facilities to achieve their full working life for the duration of the Contract Period;

(d)  the Service Provider can deliver the Services in accordance with this Agreement and the Service Specifications; and

(e)  the Facilities are handed back to the Authority on the Expiry Date in a condition complying with the requirements of this clause 26.1.
