26.5  Non Compliance by Service Provider

If a survey shows that the Service Provider has not complied or is not complying with its obligations under clause 26.1, the Authority shall:

(a)  notify the Service Provider of the standard that the condition of the Facilities should be in to comply with its obligations under clause 26.1;

(b)  specify a reasonable period within which the Service Provider must carry out such rectification and/or maintenance work; and

(c)  be entitled to be reimbursed by the Service Provider for the cost of the survey.
