34.5  Decision to Refuse Admission

The decision of the Authority as to whether any person is to be refused admission to the Site pursuant to clause 34.4 shall be final and conclusive, and/or where reasons are given and found to be unreasonable.  If the Authority declines to give reasons for exercising its rights under clause 34.3 and clause 34.4, the Authority shall indemnify the Service Provider and keep the Service Provider indemnified from and against any injury, claims, costs and expenses (including legal expenses) and or damage suffered or incurred by the Service Provider, provided that the Service Provider or the FM Contractor or the Services Contractor has used its reasonable endeavours to redeploy that person elsewhere and/or to mitigate the claim.
