36.1  Delays in Planned Completion Date due to a Compensation Event

If, on or before the Actual Completion Date, as a direct result of the occurrence of a Compensation Event:

(a)  the Service Provider is unable to achieve the Actual Completion Date on or before the Planned Completion Date, or following the Planned Completion Date, on or before the Long Stop Date;

(b)  the Service Provider is unable to comply with its obligations under this Agreement; and/or

(c)  the Service Provider incurs costs or loses revenue,

then the Service Provider is entitled to apply for relief from its obligations and/or to claim compensation under this Agreement.
