40.1  Requirement to Maintain

The Service Provider shall, prior to commencement of the Works, at its own cost, take out and maintain or procure the taking out and maintenance of:

(a)  the insurances described in Part 1 of Schedule 18 (Insurances Matters) and any other insurances as may be required by law;

(b)  during the Service Period the insurances described in Part 2 of Schedule 18 (Insurances Matters) and any other insurances as may be required by Legislation,

and such insurances shall be effective, in each case, not later than the date on which the relevant risk commences.
