53  Termination for Breach of Refinancing Provisions

If the Service Provider wilfully breaches clause 43 (Refinancing) then the Authority may terminate this Agreement by serving a Termination Notice on the Service Provider stating:

(a)  that the Authority is terminating this Agreement pursuant to this clause 53;

(b)  that this Agreement shall terminate on the date specified in the Termination Notice which must be a minimum of twenty (20) Business Days after the date of receipt of the Termination Notice; and

(c)  whether the Authority has chosen to exercise its options under clause 58.4 (Effect of Termination),

and this Agreement shall terminate on the date specified in the Termination Notice as referred to in clause 53(b).
