59.1  Termination of Agreement

If this Agreement is terminated:

(a)  pursuant to clause 55 (Voluntary Termination and Termination on an Authority Break Point Date) or clause 56 (Authority Default) or clause 78 (Local Government (Contracts) Act 1997), then the Authority shall pay compensation to the Service Provider in accordance with Part 2 of Schedule 22 (Compensation on Termination);

(b)  pursuant to clause 51 (Service Provider Default) then the Authority shall pay compensation to The Authority in accordance with Part 3 of Schedule 22 (Compensation on Termination);

(c)  pursuant to clause 53 (Termination for Breach of Refinancing Provisions) or clause 54 (Termination for Corrupt Gifts), then the Authority shall pay compensation to the Service Provider in accordance with Part 4 of Schedule 22 (Compensation on Termination);

(d)  pursuant to clause 57 (Termination following a Force Majeure Event) or clause 40.12(a)(i) or 40.12(b)(ii) (Insurance), then the Authority shall pay compensation to the Service Provider in accordance with Part 5 of Schedule 22 (Compensation on Termination).
