62.1  No Liability

Subject to clause 4.1 (Authority Warranted Data) the Authority shall not be liable to the Service Provider for, and the Service Provider shall not seek to recover from the Authority (or from any Authority Party), any damages, losses, costs, liabilities or expenses which may arise (whether in contract, tort or otherwise) from the adoption, use or application of the Disclosed Data by, or on behalf of, the Service Provider, the Independent Certifier or any Service Provider Party.
