23.1  Maintenance

The Contractor shall ensure on a continuing basis that at all times its maintenance and operating procedures set out in the Service Delivery Proposals are and remain sufficient to ensure that:

(a)  the [Facility is/Facilities are] Available as required by this Agreement and the Authority's Requirements;

(b)  the [Facility is/Facilities are] kept in good structural and decorative order (subject to fair wear and tear) in accordance with this Agreement, the Authority's Requirements and the Service Delivery Proposals;

(c)  it can maintain the design intention of the [Facility/Facilities] to achieve [its/their] full working life as set out in [Section  ] of the Services Specification for the duration of the Contract Period;

(d)  the Contractor can deliver the Services in accordance with this Agreement and the Services Specification; and

(e)  the [Facility is/Facilities are] handed back to the Authority on the Expiry Date in a condition complying with the Handback Requirements.
