23.5 Unprogrammed Maintenance Works
(a) If during the Minimum Opening Hours, the need arises for Maintenance Works which are not scheduled to be carried out as part of Programmed Maintenance (Unprogrammed Maintenance Works), the Contractor may carry out such Unprogrammed Maintenance Works provided that the Contractor shall notify the Authority's Representative as soon as reasonably possible (and in any event, within two (2) Business Days of the occurrence) of the extent of the necessary Unprogrammed Maintenance Works and the reasons for them. The Contractor shall take all reasonable steps to minimise the duration of such Unprogrammed Maintenance Works.
(b) For the avoidance of doubt, there shall be no restrictions on the performance of Unprogrammed Maintenance Works carried out outside of the Minimum Opening Hours.
(c) Nothing in this clause 23.5 (Unprogrammed Maintenance Works) shall prevent the Authority from making any deductions from the Unitary Charge in accordance with this Agreement.
