28.3  Third Party Use

(a)  Subject to the Authority Leisure Requirements [and the Services Specification], the Contractor shall be entitled to charge for, and be paid by, each User, a fee determined by the Contractor for the use made of the [Facility/Facilities] in accordance with Part B (Leisure) of the Services Specification.  

(b)  The Contractor shall procure that the Leisure Operator shall on a continuous basis do all things reasonably necessary or desirable (in accordance with Good Industry Practice) to maximise the Leisure Operator's Income [and mitigates it losses in Related Operating Costs].
