41.4  Authority's Pricing Requirements

If there is any one (1) failure to comply with the Authority's Pricing Requirements, the Authority may serve a notice on the Contractor:

(a)  specifying that the notice is a pricing warning notice (Pricing Warning Notice);

(b)  giving reasonable details of the breach; and

(c)  stating that if two (2) or more failures to comply with the Authority's Pricing Requirements occur within the three (3) month period after the date of service of the Pricing Warning Notice, this Agreement may be terminated.
