41.5

41.5  If, following service of a Pricing Warning Notice under clause 41.4 (Authority's Pricing Requirements), the Contractor can provide detailed written evidence to the Authority's satisfaction (acting reasonably) within five (5) Business Days of receipt of the Pricing Warning Notice, that the Contractor:

(a)  did not in fact fail to comply with the Authority's Pricing Requirements; or

(b)  did in fact fail to comply with the Authority's Pricing Requirements due to a technical matter or fault which has since been rectified in full to the Authority's satisfaction,

then the Authority shall withdraw the Pricing Warning Notice.
