45.1  Compensation Provisions

If this Agreement is terminated pursuant to:

(a)  Clause 40.1 (Voluntary Termination by the Authority), the provisions of clause 48 (Compensation on Termination for Authority Default/Voluntary Termination/ Authority Break Point Date) shall apply;

(b)  Clause 40.2 (Termination on an Authority Break Point Date), the provisions of clause 48 (Compensation on Termination for Authority Default/Voluntary Termination/ Authority Break Point Date) shall apply;

(c)  Clause 40.3 (Termination on Authority Default), the provisions of clause 48 (Compensation on Termination for Authority Default/Voluntary Termination/ Authority Break Point Date) shall apply;

(d)  Clause 40.4 (Termination on Contractor Default), the provisions of clause 50 (Compensation on Termination for Contractor Default) shall apply; or

(e)  Clause 42 (Termination for Breach of Refinancing Provisions), the provisions of clause 49 (Compensation on Corrupt Gifts, Fraud and Refinancing Breaches) shall apply;

(f)  Clause 43 (Termination on Corrupt Gifts and Fraud), the provisions of clause 49 (Compensation on Corrupt Gifts, Fraud and Refinancing Breaches) shall apply;

(g)  Clause 44 (Termination on Force Majeure), the provisions of clause 51 (Compensation on Termination for Force Majeure) shall apply;

(h)  Clause 65 (Risks that become Uninsurable), the provisions of clause 51 (Compensation on Termination for Force Majeure) shall apply; or

(i)  Clause 83.3 (Failure to issue a Certificate), the provisions of clause 48 (Compensation on Termination for Authority Default/Voluntary Termination/ Authority Break Point Date) shall apply.
