66.21  Access to Documents

The Contractor shall not allow the Building Contractor, the Leisure Operator or the FM Contractor access to any document relevant to issues in dispute between the Authority and the Contractor save where:

(a)  the document is relevant also to the issues relating to the Building Contract Dispute, the Leisure Contract Dispute or the FM Agreement Dispute as the case may be; and

(b)  the Contractor has first delivered to the Authority a written undertaking from the Building Contractor and/or the Leisure Operator and/or the FM Contractor (as appropriate) addressed to the Authority that they shall not use any such document otherwise than for the purpose of the dispute resolution proceedings under this Agreement and that they shall not disclose such documents or any information contained therein to any third party other than the Adjudicator or the courts or any professional adviser engaged by the Building Contractor, the Leisure Operator or the FM Contractor (as appropriate) to advise in connection with the dispute.
