9.  HEALTH AND SAFETY

9.1.  The Service Provider shall in performing the Services:-

9.1.1.  comply with all applicable health and safety Legislation including but not limited to compliance with the requirements under the Management of Health and Safety at Work Regulations 1999 to carry out a suitable and sufficient risk assessment;

9.1.2.  notify the Authority of any relevant new hazard or any relevant special precaution found to be necessary and any actions required to be taken by the Authority;

9.1.3.  notify the Authority promptly of all incidents and accidents relating to the Services reportable under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 together with any serious incidents and accidents involving members of the public or Authority employees and shall confirm in writing to the Authority any action taken by the Service Provider or recommended to be taken by the Authority to prevent a reoccurrence; and

9.1.4.  keep a full record of all incidents and accidents relating to the Services which shall be available for inspection by the Authority upon reasonable notice.
