34.3.  Funding for Qualifying Changes in Law

If the parties agree or it is determined under the Dispute Resolution Procedure that the Service Provider is required to incur additional expenditure due to a Qualifying Change in Law, then the Authority shall compensate the Service Provider for the expenditure under clause 34.5.  The Service Provider shall use its reasonable endeavours to obtain funding for such expenditure on reasonable terms.
